And so it begins…

About 6 months ago, I went to see a lawyer to enquire about the possibility of an annulment. It seems slim. I brought this news back to my ex, and told her that if she wanted an annulment, she can approach this lawyer. If there’s no word from her by end-Feb 2020, I would proceed to file for divorce.

She waited till the last week of Feb to arrange for a meeting with the lawyer. I considered waiting for her, but then it occured to me that I’ve already waited six months. I should wait no longer. So I went ahead to schedule a meeting with my own lawyer to start divorce proceedings.

This afternoon, I got a call from the first lawyer, to explain that my ex has been to see her, and that she cannot represent two parties. It’s fine if we have agreed on the terms of the divorce or annulment, but if there is a disagreement down the road, she would not be able to represent me if she was already representing my ex.

From my understanding, if my ex wants to file for an annulment, I’m not really involved, as it falls to my ex to prove that the marriage never existed. In which case, her assets remain her assets and mine remains mine. The matrimonial flat is already in the process of being sold.

I just went back to read my notes. It turns that that for annulment, I am still involved because, like divorce, we have to agree on the terms of splitting of assets. Hmmm…

Anyway, the lawyer will call me back after she has spoken to my ex.
